Medical malpractice is a legal term that describes the failure of a qualified medical professional to use sound medical professional skill or learning, following accepted 'standards of care' within the respective medical community, and rendering medical services which result in injury, loss, or damage. Examples of medical malpractice include: Misdiagnosis of, or failure to diagnose a disease or medical condition; Failure to provide appropriate treatment for a medical condition; Unreasonable delay in treating a diagnosed medical condition. In Washington state medical malpractice actions must be filed within three years of the date of the act or omission giving rise to the injury, or within one year of the date when the injury was or reasonably should have been discovered, whichever is later.
